1. Introduction

Ruj.app is a platform that utilizes artificial intelligence to enable the creation and interaction with adult content. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Creator,” or “Fan”) and Lycia Creative LTD (Company No. 14906091, registered at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, UK) (“Ruj.app,” “we,” “us,” or “our”). Please read these Terms carefully before accessing or using Ruj.app. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must not use Ruj.app.

2. Definitions

For the purposes of these Terms, the following definitions shall apply:

• “Acceptable Use Policy (AUP)”: means the rules governing permissible content and conduct on Ruj.app, as detailed in Section 7.
• “AI-Generated Content”: means text, images, videos, or other materials generated solely through artificial intelligence algorithms and processes, utilizing third-party AI services including but not limited to fal.ai, replicate.com, novita.ai, modelslab.com, openrouter.com, runpod.io, without the use of human actors, models, or real-life depictions of individuals in the content creation process.
• “Applicable Laws”: means all applicable laws, regulations, statutes, ordinances, and directives in any relevant jurisdiction, including but not limited to the laws of England and Wales, the UK Data Protection Act 2018, UK GDPR, and the UK Online Safety Act 2023.
• “Content”: means AI-Generated Content created, uploaded, or distributed on Ruj.app, including text, images, videos, and other materials.
• “Creator”: means a User who develops, uploads, and monetizes AI-Generated adult content on Ruj.app.
• “Fan”: means a User who accesses, subscribes to, or interacts with Creators’ Content on Ruj.app.
• “Fan Payments”: means payments made by Fans to access Creator Content on Ruj.app.
• “Intellectual Property Rights”: means all forms of intellectual property rights, including but not limited to copyrights, trademarks, patents, trade secrets, and moral rights, whether registered or unregistered.
• “Services” or “Platform”: means the Ruj.app platform, including but not limited to the AI-driven adult content creation and interaction services accessible via Telegram bots, any associated websites, applications, APIs, and related services provided by Ruj.app.
• “User”: means any person who accesses or uses Ruj.app, including Creators and Fans.

3. Eligibility

3.1 Age and Legal Capacity: You must be at least 18 years of age and possess the legal capacity to enter into binding contracts to use Ruj.app. By using Ruj.app, you represent and warrant that you meet these eligibility requirements. Creators must complete age and identity verification through our designated KYC provider, didit.me. Fans may be required to re-verify their age if our systems flag their account for potential age verification issues.

3.2 Prohibited Jurisdictions: Access to Ruj.app and its services is strictly prohibited in jurisdictions where adult content, as defined by Applicable Laws, is illegal. These jurisdictions may include, but are not limited to, the United Arab Emirates and Saudi Arabia. You are solely responsible for ensuring that your access to and use of Ruj.app is legal in your jurisdiction. We may restrict access to Ruj.app in certain jurisdictions at our discretion.

3.3 Accuracy of Information: You represent and warrant that all information you provide to Ruj.app, including during registration and throughout your use of the Services, is true, accurate, current, and complete. You are responsible for maintaining the accuracy of this information.

4. Account Registration

4.1 Account Registration for Creators: To become a Creator on Ruj.app, you must:

• Provide your accurate legal name, date of birth, and detailed payment information, including bank account or cryptocurrency wallet details, necessary for receiving payouts and complying with financial regulations.
• Complete KYC verification through didit.me, which may involve submitting a government-issued identification document and a facial scan for identity and age verification purposes.

4.2 Account Registration for Fans: To access and use Ruj.app as a Fan, you must:

• Declare that you are over 18 years of age by providing your birthday during the bot signup process. This birthday declaration serves as confirmation of your age for using our services.
• Provide a valid email address, which may be used for account recovery, important service communications, and policy updates.
• Provide your Telegram ID, as our services are primarily accessed and utilized through the Telegram platform.

4.3 Account Information Accuracy and Security: You are responsible for ensuring that all information provided during account registration and use is accurate, complete, and not misleading. You are also solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

4.4 Consequences of Violation: We reserve the right to suspend or terminate accounts found to have incomplete, false, misleading, or inaccurate information. In cases of suspected fraudulent activity or violation of these Terms, we may also report such activities to relevant legal authorities.

5. Content Rules

5.1 Creator Content Obligations: As a Creator, you are solely responsible for all Content you create and upload to Ruj.app. You warrant and represent that all of your Content shall:

• Be exclusively generated by artificial intelligence algorithms and processes, without the use of human actors, models, or realistic depictions of identifiable individuals without their explicit and verifiable consent. Content that depicts real individuals, deepfakes, or realistic representations of identifiable people without explicit consent is strictly prohibited.
• Comply fully with the UK Online Safety Act 2023, this Acceptable Use Policy (Section 7), and all other Applicable Laws.
• Not include any Illegal Material, which includes but is not limited to: Child Sexual Abuse Material (CSAM), non-consensual explicit material, hate speech, discriminatory content, content promoting violence, terrorism, self-harm, or illegal activities, content that exploits, abuses, or endangers children, misinformation, disinformation, harmful hoaxes, content infringing Intellectual Property Rights, content violating privacy or promoting doxing, defamatory or libelous content, and technically harmful content (viruses, malware, etc.). Specifically, prohibited content includes: Hate speech, Violence or gore, Zoophilia or bestiality, Pedophilia, Necrophilia, Rape, Scat, Drugs, Hacking, and any other content deemed illegal or harmful under Applicable Laws or our AUP.
• Undergo content moderation processes implemented by Ruj.app, which may include automated filtering and human review. However, the implementation of content moderation measures by Ruj.app does not relieve you of your sole responsibility to ensure your Content is compliant.
• You agree to indemnify and hold Ruj.app harmless from any claims, damages, losses, or liabilities arising from or related to your Content, including any violations of these Content Rules or Applicable Laws (See Section 9 for Indemnification details).

5.2 Fan User Conduct Obligations: As a Fan, you agree to the following conduct rules:

• You shall not download, copy, reproduce, distribute, or publicly display any Creator Content outside of the Ruj.app platform without explicit written permission from Ruj.app and the respective Creator.
• You shall not attempt to circumvent any paywalls, access controls, or security measures implemented on Ruj.app.
• You shall not use bots, scrapers, or other automated means to access or collect Content or data from Ruj.app improperly or in violation of these Terms.
• You shall not engage in any form of harassment, abuse, stalking, threatening, or disrespectful behavior towards other Users or Creators on Ruj.app or in connection with the Services.
• You shall comply with the Acceptable Use Policy (Section 7) in all your interactions and use of Ruj.app.
• You shall not attempt to reverse engineer, decompile, or access the underlying AI models or algorithms used by Ruj.app.

5.3 Content Moderation and Enforcement: Ruj.app reserves the right to moderate and enforce these Content Rules. We may, but are not obligated to, review Content and user conduct for violations. Upon becoming aware of potential violations, we may take action, including but not limited to: removing or modifying Content, issuing warnings to users, temporarily suspending accounts, permanently terminating accounts, and reporting illegal content or activities to relevant legal authorities. While we strive to provide notice when taking enforcement action, Ruj.app reserves the right to take immediate action, including account termination and content removal, without prior notice in cases of severe violations of these Terms, the AUP, or when legally required. We encourage Users to report any suspected violations of these Content Rules or Terms of Service to [email protected]. We will investigate all reports and take appropriate action in accordance with our policies.

6. Monetization & Payouts (Creators Only)

6.1 Creator Earnings & Service Fees (Credit Consumption Based): Ruj.app utilizes a credit-based system for User interactions with AI Characters and operates on a revenue-sharing model based on overall User Credit purchases and Creator engagement. Creators earn revenue based on the cumulative consumption of User Credits by Users across the Ruj.app platform when engaging in User Interactions with their AI Characters. Creators do not directly set prices for User Interactions. Instead, Users purchase platform-wide User Credits that can be spent to interact with *any* Creator’s AI Character. For every User Credit spent on User Interactions across the platform, a portion is attributed to Creator Earnings, while Ruj.app retains a service fee. The specific service fee percentage factored into the calculation of Creator Earnings may vary depending on platform-wide factors, creators level and is determined solely by Ruj.app. Ruj.app retains this service fee in consideration for providing the AI services, platform infrastructure, content moderation, user acquisition, and operational support necessary for the Ruj.app platform. Service fees are non-refundable and are factored in before Creator Earnings are calculated and made available for payout.

6.2 Payouts to Creators:

• Minimum Payout Threshold: Creators must accrue a minimum balance of $20 USD (twenty American dollars) in Creator Earnings before a payout can be processed. This minimum threshold applies to the USD value of accumulated Creator Earnings derived from User Credit consumption attributed to their AI Characters.
• Payout Methods: Payouts of Creator Earnings are available via:
  • Bank Transfer: Subject to bank processing fees and international transfer times, which may vary.
  • Cryptocurrency Wallet: We currently support payouts in  USDT (TRC-20). Cryptocurrency payouts may be subject to transaction fees charged by the cryptocurrency network. Please also be aware of potential fluctuations in cryptocurrency exchange rates.
• Payout Schedule: Payouts of eligible Creator Earnings are processed and disbursed between the 1st and 5th business day of each calendar month.
• Payment Eligibility Period: Creator Earnings become eligible for payout after a period of fifteen (15) days has elapsed from the end of the calendar month in which the User Credit consumption occurred that generated those earnings. This 15-day period serves as a buffer to account for potential refunds, fraudulent transactions related to User Credit purchases, or chargebacks that may affect the overall revenue pool from which Creator Earnings are derived. Only Creator Earnings that have successfully passed this 15-day eligibility period without being subject to reduction due to User Credit purchase issues will be included in the Creator’s eligible payout balance for the next scheduled payout cycle.
• Creator Earnings Calculation and Rate: Creator Earnings are calculated based on total User Credits consumed across the platform during User Interactions with a Creator’s AI Characters in a given calendar month. Ruj.app utilizes a proprietary formula to determine Creator Earnings based on overall platform revenue, User Credit consumption patterns, and other relevant factors. While the specific rate may fluctuate according to creators level, bot health status and other factors currently, Creators may expect to earn minimum $1,5 USD for every 1000 User Credits consumed in interactions with their AI Characters. This rate is subject to change at Ruj.app’s sole discretion. The final Creator Earnings amount and payout rate are determined solely by Ruj.app.
• Taxes: Creators are solely responsible for declaring all income earned through Ruj.app, including Creator Earnings payouts, to the appropriate tax authorities and for complying with all applicable tax regulations in their jurisdiction.

6.3 Adjustments for Refunds, Chargebacks, and Fraudulent Credits: Creator Earnings are directly derived from the overall revenue generated through User Credit purchases. Accordingly, Creator Earnings may be subject to reduction, adjustment, or forfeiture in cases where User Credit purchases that contributed to the overall revenue pool are later subject to refunds, chargebacks, reversals, or are determined to be fraudulent. Specifically, Creators may see adjustments to their earnings to offset the impact of fraudulent User Credit purchases or User Credit purchase refunds, even if those issues are not directly linked to interactions with their specific AI Characters. Ruj.app reserves the right to make necessary adjustments to Creator Earnings to reflect actual net revenue from User Credit sales after accounting for refunds, chargebacks, and fraud.

6.4 Payout Discretion and Holds: Ruj.app reserves the right to withhold, delay, or suspend payouts of Creator Earnings in cases of suspected fraudulent activity related to User Credit purchases or Creator account activity, violations of these Terms or the AUP by the Creator or associated User accounts, pending investigations into Creator account activity or User Credit transactions, or as required by Applicable Laws or legal process.

7. Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) outlines the rules and guidelines governing permissible content and conduct on Ruj.app. All Users of Ruj.app must comply with this AUP at all times. Violations of this AUP may result in enforcement actions as described below.

7.1 Prohibited Content:

You are prohibited from creating, uploading, or distributing the following types of content on Ruj.app:

• Non-AI Generated Content: Content that is not exclusively generated by artificial intelligence algorithms and processes.
• Illegal Content: Content that violates Applicable Laws, including but not limited to:
  • Child Sexual Abuse Material (CSAM)
  • Non-consensual explicit material
  • Hate speech
  • Discriminatory content
  • Content promoting violence, terrorism, self-harm, or illegal activities
  • Content that exploits, abuses, or endangers children
  • Misinformation, disinformation, harmful hoaxes
  • Content infringing Intellectual Property Rights
  • Content violating privacy or promoting doxing
  • Defamatory or libelous content
  • Technically harmful content (viruses, malware, etc.)
  • Hate speech, Violence or gore, Zoophilia or bestiality, Pedophilia, Necrophilia, Rape, Scat, Drugs, Hacking any other content deemed illegal or harmful under Applicable Laws or our AUP.

7.2 Prohibited User Conduct:

You are prohibited from engaging in the following conduct while using Ruj.app:

• Harassment, Bullying, Hate Speech, Discrimination, and Disrespectful Behavior:You are strictly prohibited from engaging in any form of harassment, bullying, intimidation, stalking, threatening behavior, or abusive conduct towards other Users (Fans or Creators), Ruj.app staff, or any individuals associated with the platform. This includes, but is not limited to:
  • Hate Speech and Discrimination: Promoting or expressing hatred, prejudice, discrimination, or disparagement based on race, ethnicity, religion, gender, gender identity, sexual orientation, disability, age, national origin, or any other protected characteristic. This includes using derogatory language, slurs, stereotypes, or making generalizations that incite hatred or promote harmful ideologies.
  • Bullying and Harassment: Repeatedly targeting, intimidating, or singling out other users for abuse, ridicule, or belittlement. This includes personal attacks, name-calling, offensive jokes directed at individuals, and persistent unwanted contact after being asked to stop.
  • Threats and Violence: Making threats of violence, harm, or self-harm against others or oneself. This includes direct threats, veiled threats, and language that promotes or glorifies violence.
  • Doxing and Privacy Violations: Sharing another person’s private or confidential information without their explicit consent (doxing).
  • Sexual Harassment: Making unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature that creates a hostile environment.
  • Disrespectful and Abusive Language: Using consistently rude, aggressive, condescending, or inflammatory language in interactions with other users or staff, even if not explicitly discriminatory or hateful.
  • Incitement and Provocation: Deliberately attempting to provoke, incite, or escalate conflicts with other users through aggressive or inflammatory statements.
• Spam and Unsolicited Promotion:You are prohibited from using Ruj.app to engage in spamming, unsolicited advertising, or any form of unauthorized promotion or marketing. This includes, but is not limited to:
  • Mass Messaging and Unsolicited Content: Sending unsolicited messages, promotions, advertisements, or links to a large number of users or groups, especially if irrelevant to the context of the platform.
  • Excessive Self-Promotion: Repeatedly promoting your own Creator profile or content in a way that is disruptive or detracts from the platform experience for other users, particularly in areas not designated for self-promotion.
  • Link Spamming: Flooding chat areas or public spaces with irrelevant or excessive links to external websites, services, or products.
  • Affiliate Marketing Spam: Engaging in undisclosed affiliate marketing or referral schemes that are deceptive or misleading.
  • Commercial Solicitation in Non-Commercial Areas: Using areas intended for community interaction and non-commercial discussion for direct commercial solicitation or sales pitches.
  • Fake Engagement and Bots: Using bots or automated accounts to artificially inflate engagement metrics, followers, or views, or to generate spam content.
• Impersonation:You are prohibited from impersonating other Users, Creators, Ruj.app staff, or any other person or entity in a misleading or deceptive manner. This includes, but is not limited to:
  • Account Impersonation: Creating an account with a username or profile that is confusingly similar to or intentionally mimics another user, Creator, or Ruj.app official to deceive or mislead others.
  • False Claims of Affiliation: Falsely claiming to be affiliated with or endorsed by Ruj.app, another User, Creator, or any other entity when no such affiliation or endorsement exists.
  • Deceptive Profile Information: Using profile information (profile picture, bio, etc.) to misrepresent your identity or affiliation.
  • Content Impersonation: Creating Content that falsely attributes authorship to another User or Creator.
  • Communication Impersonation: Sending messages or communications that are designed to appear as if they are from another User, Creator, or Ruj.app official to deceive or manipulate others.
• Privacy Violations:You are prohibited from violating the privacy of other Users or individuals. This includes, but is not limited to:
  • Doxing: Sharing another person’s Personally Identifiable Information (PII) without their explicit consent, including but not limited to real name, address, phone number, email, social media profiles, employment information, or other private details.
  • Unauthorized Recording or Monitoring: Recording or monitoring private chats or communications without the explicit consent of all participants.
  • Sharing Private Content: Distributing or sharing private Content, messages, or communications that were intended to be confidential without the permission of the originator.
  • Stalking and Unwanted Contact: Engaging in persistent and unwanted contact with another user after they have clearly indicated they wish to be left alone.
  • Attempting to Gain Unauthorized Access to Private Information: Trying to access another user’s account information, chat logs, or private data without authorization.
• Disruption and Abuse of Services:You are prohibited from engaging in any conduct that disrupts the normal operation of Ruj.app, abuses its features, or negatively impacts the experience of other Users. This includes, but is not limited to:
  • Platform Manipulation: Exploiting glitches, bugs, or vulnerabilities in Ruj.app’s platform or services to gain an unfair advantage, bypass restrictions, or disrupt functionality.
  • Denial-of-Service (DoS) Attacks: Intentionally overloading or disrupting Ruj.app’s servers or networks to make the service unavailable to others.
  • Excessive Use of Resources: Using Ruj.app’s resources (bandwidth, storage, processing power, etc.) in an excessive or abusive manner that degrades the service for other users.
  • Circumventing Rate Limits or Restrictions: Attempting to bypass or circumvent any rate limits, usage restrictions, or platform rules put in place to ensure fair usage and prevent abuse.
  • Malicious Reporting: Filing false or malicious reports against other users or content with the intent to harass, silence, or unfairly disadvantage them.
  • Interfering with Content Moderation: Attempting to interfere with or undermine Ruj.app’s content moderation processes or staff.
  • Abuse of Support Channels: Submitting frivolous, repetitive, or abusive requests to Ruj.app’s support channels.
  • Misuse of Platform Features: Using platform features in a way that is not intended or that disrupts the intended functionality (e.g., misusing reporting features, abusing comment sections).
• Account Manipulation:You are prohibited from engaging in account manipulation or creating multiple accounts for abusive or deceptive purposes. This includes, but is not limited to:
  • Creating Multiple Accounts to Evade Restrictions: Creating multiple accounts to bypass account suspensions, bans, or other platform restrictions imposed on a previous account.
  • Sockpuppet Accounts: Creating and using multiple accounts to artificially inflate your own content’s engagement, followers, or influence, or to manipulate discussions or opinions.
  • Mass Account Creation for Spam: Creating large numbers of accounts for the purpose of distributing spam, unsolicited promotions, or malicious content.
  • Account Trading or Selling: Buying, selling, trading, or gifting Ruj.app accounts.
  • Automated Account Creation (Bots): Using bots or automated scripts to create accounts in violation of these Terms.
  • Account Sharing: Allowing multiple individuals to access and use a single Ruj.app account (account sharing).

7.3 Prohibited Technical Actions:

You are prohibited from undertaking the following technical actions in connection with Ruj.app:

• Reverse Engineering: Attempting to reverse engineer, decompile, or access the underlying AI models or algorithms used by Ruj.app.
• Security Circumvention: Attempting to bypass security measures, access controls, or paywalls implemented on Ruj.app.
• Account Sharing: Sharing your account credentials with any other person or entity.
• Malicious Software: Distributing or attempting to distribute malware, viruses, worms, Trojan horses, or other harmful code through Ruj.app.
• Unauthorized Access: Attempting to gain unauthorized access to any systems, networks, or data related to Ruj.app.
• Service Interference: Taking any action that interferes with the proper functioning of Ruj.app or the Services provided to other Users.

7.4 Consequences of AUP Violations:

Ruj.app reserves the sole and absolute discretion to determine whether a violation of this AUP has occurred and to take enforcement actions as we deem appropriate. The severity of the enforcement action will depend on the nature and severity of the AUP violation, user history, and other relevant factors, as determined by Ruj.app in its sole discretion. Enforcement actions may include, but are not limited to, any one or more of the following:

• Content-Related Actions:
  • Content Removal or Modification: Removing or modifying any Content that violates this AUP or that we deem inappropriate, offensive, or harmful, without prior notice.
  • Content Demotion or Visibility Limitation: Reducing the visibility or reach of Content that violates this AUP, limiting its discoverability on the platform.
• Account-Related Actions:
  • Warning: Issuing a formal warning to the User regarding their violation of the AUP. Warnings may be logged on the User’s account and may be considered in future enforcement decisions.
  • Temporary Account Suspension (Partial Ban): Temporarily suspending a User’s access to certain features of Ruj.app, or to the entire platform, for a specified period. This may include restricting the ability to create content, interact with other users, or access certain areas of the platform.
  • Permanent Account Ban (Permanent Ban): Permanently terminating a User’s account and access to Ruj.app and all associated Services. Permanent bans are typically reserved for severe or repeated violations of the AUP.
  • Account Feature Restrictions: Imposing limitations on account features, such as limiting chat functionality, content creation abilities, or access to monetization features.
• Financial Actions (Creators Only):
  • Withholding or Forfeiture of Payments: Withholding or forfeiting accrued or future earnings from Fan Payments if the violation is related to Content monetization or if the violation has resulted in chargebacks or refunds. This may include forfeiture of earnings below the minimum payout threshold upon account termination, as outlined in Section 10.3.
  • Chargebacks and Deductions: Deducting costs and expenses incurred by Ruj.app as a result of AUP violations, including chargebacks, refunds, and administrative fees, from a Creator’s payable balance.
• Legal Actions:
  • Reporting to Authorities: Reporting illegal content or activities, including suspected criminal behavior or child exploitation, to relevant law enforcement agencies, regulatory bodies, or governmental authorities, as required by Applicable Laws.
  • Legal Proceedings (Law Suites): Initiating legal proceedings against Users who engage in severe or repeated violations of the AUP that cause harm to Ruj.app, other users, or third parties, or that violate Applicable Laws. This may include seeking injunctive relief, damages, and legal costs.
  • Cooperation with Legal Requests: Cooperating fully with valid legal requests, subpoenas, court orders, or law enforcement investigations related to AUP violations or user conduct on Ruj.app.

No Refund or Compensation: Users acknowledge and agree that Ruj.app shall not be liable for any loss, damage, or refund incurred as a result of enforcement actions taken for AUP violations, including account suspension or termination, content removal, or forfeiture of earnings.

AUP Updates: Ruj.app reserves the right to modify this “Consequences of AUP Violations” section and the enforcement actions we may take at any time, without prior notice. Users are expected to remain informed of the current AUP and these consequences.

7.5 AUP Updates:

Ruj.app may update this AUP from time to time. We will notify Users of significant changes as described in Section 13. Continued use of Ruj.app after such updates constitutes acceptance of the revised AUP. Users are encouraged to periodically review this AUP to ensure compliance.

8. Intellectual Property

8.1 Creator Content Ownership and License: Subject to these Terms, you, as a Creator, retain ownership of the rights to the prompts and AI-generated outputs you create using Ruj.app’s Services. However, by uploading or creating Content on Ruj.app, you grant to Lycia Creative LTD a global, royalty-free, non-exclusive license (for the duration of content hosting on Ruj.app) to host, store, process, display, distribute, and otherwise use your Content on and through the Ruj.app Platform for the purposes of operating, providing, promoting, and improving the Services, and as otherwise permitted by these Terms and our Privacy Policy. This license is necessary to enable us to provide the Ruj.app platform and its functionalities to Users. We recommend you consult with legal counsel regarding the evolving legal landscape of intellectual property rights in AI-generated content. Ruj.app does not provide legal advice on the ownership of Intellectual Property Rights in AI-Generated Content.

8.2 Fan Rights Regarding Creator Content: Fans acknowledge and agree that they acquire no ownership rights, licenses, or Intellectual Property Rights whatsoever in any Creator Content accessed or purchased through Ruj.app. Fans are strictly prohibited from using Creator Content outside the Ruj.app platform, including downloading, copying, distributing, or publicly displaying Content, without explicit written permission from Ruj.app and the respective Creator.

8.3 Ruj.app Intellectual Property: Ruj.app, including but not limited to its software, AI models, algorithms, design, trademarks, logos, graphics, and all other elements of the Platform (excluding User Content), is owned by or licensed to Lycia Creative LTD and is protected by Intellectual Property Rights and Applicable Laws. These Terms do not grant you any right, title, or interest in or to Ruj.app’s Intellectual Property. You are prohibited from infringing upon Ruj.app’s Intellectual Property Rights in any manner.

9. Liability & Disclaimers

9.1 Ruj.app Liability Limitations: To the maximum extent permitted by Applicable Law, Ruj.app, Lycia Creative LTD, its affiliates, officers, directors, employees, and agents shall not be liable for:

• The accuracy, legality, or appropriateness of any AI-generated Content created or accessed through Ruj.app.
• Any losses, damages, or liabilities arising from or related to: unauthorized access to or use of your account; data breaches; service interruptions, outages, delays, or errors; actions of third-party service providers (including but not limited to Telegram, payment processors, and AI API providers); events outside our reasonable control (force majeure); or any other circumstances beyond our direct control.
• Ruj.app and the Services are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
• Ruj.app does not endorse and is not responsible for the views, opinions, or Content expressed or created by Users (Creators or Fans) on the Platform. User Content is the sole responsibility of the User who creates or publishes it.

9.2 User Indemnification: You agree to indemnify, defend, and hold harmless Lycia Creative LTD, its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your Content; (b) your use of Ruj.app and Services; (c) your conduct on Ruj.app; (d) your violation of these Terms, the AUP, or any Applicable Laws; (e) your infringement of any Intellectual Property Rights or other rights of any third party; and (f) any taxes or duties arising from your activities on Ruj.app. This indemnification obligation survives the termination of these Terms and your use of Ruj.app.

10. Termination

10.1 Termination by Ruj.app: Ruj.app reserves the right to suspend, limit, or permanently terminate your account and access to the Services at any time, with or without cause, including but not limited to the following reasons:

• Violation of these Terms of Service or the Acceptable Use Policy (Section 7).
• Suspected fraudulent, illegal, or abusive activity.
• To comply with legal or regulatory requirements or law enforcement requests.
• Conduct that Ruj.app deems harmful to the Platform, other Users, or third parties.
• Prolonged inactivity of a Fan account (as determined by Ruj.app, e.g., no login or subscription activity for 1 year).
• For business reasons, including platform shutdown or significant service changes.

10.2 Termination by User: You may terminate your account at any time by [Specify method: e.g., accessing account settings and following account deletion procedures, or by contacting [email protected]]. Upon your request for account termination, we will process your request in accordance with our Privacy Policy. Please refer to Section 5 of our Privacy Policy for details on data retention upon account deletion.

10.3 Consequences of Termination:

• For Creators: Upon termination of a Creator account, any unpaid earnings below the minimum payout threshold of £50 GBP at the time of termination will be forfeited to cover administrative costs and legal compliance obligations associated with account closure. For Creators with accrued and payable earnings above the £50 GBP threshold, Ruj.app will make commercially reasonable efforts to pay out the remaining balance within 60 days of termination, after deducting any applicable fees, chargebacks, or other amounts owed to Ruj.app.
• For Fans: Upon termination of a Fan account, your access to Ruj.app Services and any subscribed Creator Content will cease immediately. Any active subscriptions will be automatically cancelled, and refunds will not be provided for any remaining subscription period, except as may be required by Applicable Law.

10.4 Notice of Termination: While Ruj.app reserves the right to terminate accounts without prior notice in cases of severe violations of these Terms or legal necessity, we will make reasonable efforts to provide you with notice of account termination and the reasons for termination, where possible, via email or Telegram message, before permanent account closure. However, we provide no guarantee of advance notice in all circumstances.

10.5 Survival: The following sections of these Terms shall survive any termination or expiration of these Terms: 8 (Intellectual Property), 9 (Liability & Disclaimers), 10 (Termination – clauses that need to survive like forfeiture conditions etc.), 11 (Dispute Resolution), 12 (Governing Law), 13 (Updates), and any other provisions that by their nature are intended to survive termination.

11. Dispute Resolution

11.1 Informal Dispute Resolution: We encourage you to first contact us directly at [email protected] to attempt to resolve any disputes or concerns informally and efficiently.

11.2 Mediation: If informal resolution is unsuccessful, we agree to attempt to resolve the dispute through mediation in good faith. Mediation shall be conducted in London, England, and shall be facilitated by a mediator accredited by a recognized UK mediation organization, mutually agreed upon by both parties. The costs of mediation shall be shared equally by both parties.

11.3 Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved through mediation within [Number, e.g., 60 days] of initiation of mediation shall be finally resolved by binding arbitration under the Rules of the London Court of International Arbitration (LCIA Rules), which Rules are deemed to be incorporated by reference into this clause.

• The seat (legal place) of arbitration shall be London, England.
• The language of the arbitration shall be English.
• The decision of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction.

11.4 Injunctive Relief Exception: Notwithstanding the foregoing dispute resolution process, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in London, England, to prevent actual or threatened infringement, misappropriation, or violation of a party’s Intellectual Property Rights or to prevent imminent harm, without first resorting to mediation or arbitration.

11.5 Class Action Waiver: To the fullest extent permitted by Applicable Law, you agree that any dispute resolution proceedings, whether in arbitration or court, will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales, and you irrevocably submit to the jurisdiction of such courts.

13.1 Notification of Changes: We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. We will provide notice of any material changes by posting the updated Terms on our website and notifying you through our official Ruj.app Telegram channels [Specify Channel Name(s) if applicable] and/or via email to your registered email address.

13.2 Continued Use Constitutes Acceptance: Your continued access to or use of Ruj.app Services after 30 days from the date of notification of any changes to these Terms will constitute your acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue your use of Ruj.app.

13.3 Archive of Prior Versions: We will maintain an archive of prior versions of these Terms of Service, which will be accessible at our policy archives.
