Ruj.app Digital Millennium Copyright Act (DMCA) Policy

Ruj.app, operated by Lycia Creative LTD (“Ruj.app,” “we,” “us,” or “our”), respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This DMCA Policy outlines our procedures for addressing notices of alleged copyright infringement concerning content made available on the Ruj.app platform, including content generated by artificial intelligence (“AI-Generated Content”).

Purpose

This DMCA Policy informs Users of Ruj.app, including Creators and general Users, of the procedures established by Ruj.app for reporting alleged copyright infringement and for responding to such reports. Ruj.app strives to maintain a platform that respects the intellectual property rights of content creators and copyright holders.

Reporting Alleged Copyright Infringement (DMCA Notice)

If you believe that your copyrighted work has been infringed by AI-Generated Content or other content available on Ruj.app, you have several options to initiate a report:

Option 1: In-Character Telegram Reporting (Simplified Initiation): Within a Creator’s AI Character on Telegram, Users can initiate a copyright infringement report by using the /report command and selecting the “DMCA” option from the available report categories.
- Functionality: Using the /report command with the “DMCA” option will trigger a simplified reporting process directly within the Telegram interface. This method allows for immediate flagging of potentially infringing content and sends an initial notification to Ruj.app for review.
- Formal DMCA Notice Still Required: Please be aware that initiating a report via the /report command in Telegram is a simplified *initiation* method for your convenience. And helps us to act quickly to remove bot from our services. To ensure full DMCA compliance and for Ruj.app to take formal action under the DMCA, you must still submit a complete and valid written DMCA Notice to our Designated Copyright Agent as described in Option 2 below. The Telegram report serves as an initial flag but does not replace the need for a formal DMCA Notice.
Option 2: Formal Written DMCA Notice (Required for Full Compliance): As the primary and legally compliant method, you may submit a formal written notification (“DMCA Notice”) to our Designated Copyright Agent. To be effective, your DMCA Notice must substantially include the following information, as required by the DMCA:
1. Identification of the Copyrighted Work: A sufficiently detailed description of the copyrighted work(s) you claim has been infringed. This should include:
  - The specific work claimed to be infringed (e.g., title, description, registration number if applicable).
  - If multiple copyrighted works are covered by a single notification, please provide a representative list of such works.
  - The location (e.g., URL) or source of the authorized copyrighted work.
2. Identification of the Infringing Content: Clear and reasonably specific identification of the material that you claim is infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Ruj.app to locate the material. This should include:
  - Specific URLs or other unique identifying information of the allegedly infringing content as it appears on Ruj.app (e.g., links to the AI Character profile, specific content posts, or chat logs, if applicable and directly infringing).
  - Where possible, please specify the portion(s) of the AI-Generated Content or other material that you believe is infringing.
3. Contact Information of the Complainant: Information reasonably sufficient to permit Ruj.app to contact the complaining party, such as:
  - Your full legal name (or the name of the rights holder if you are acting on their behalf).
  - Your address, telephone number, and email address.
  - If applicable, the name and contact information of the company or organization you represent.
4. Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. Example: “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., fair use).”
5. Statement of Accuracy and Authority: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Example: “I hereby state, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. For electronic submissions, a typed full legal name will be considered a valid electronic signature.

Please note: To ensure efficient processing of formal DMCA Notices (Option 2), we strongly encourage submitting them electronically via email. Sending your notice via postal mail may result in delays in processing. For initial simplified reports, you may use the Telegram /report command (Option 1).

Ruj.app’s Response to DMCA Notices

Upon receipt of a valid and complete DMCA Notice (whether initiated via Telegram or submitted formally), Ruj.app will undertake the following actions, in accordance with the DMCA:

Expeditious Review and Action: We will review all DMCA reports, including those initiated via Telegram, and will act expeditiously to remove or disable access to the material that is claimed to be infringing when a valid and complete DMCA Notice is received and infringement is reasonably apparent. For Telegram reports, we will investigate the initial flag promptly and may request further formal notice if required for full DMCA compliance.
Notification to the Creator (if applicable): We will take reasonable steps to promptly notify the Creator who made the allegedly infringing content available, providing them with a copy of the DMCA Notice and informing them of the content removal or disablement.
Record Keeping: We will maintain records of all DMCA Notices and Telegram reports we receive and our responses.
Repeat Infringer Policy: Ruj.app maintains a policy for the termination, in appropriate circumstances, of Users who are repeat infringers of copyright.

DMCA Counter-Notification Procedure

If a Creator believes that their AI Character or other content was mistakenly removed or disabled as a result of a DMCA Notice, they have the right to submit a counter-notification (“DMCA Counter-Notice”) to our Designated Copyright Agent. To be effective, your DMCA Counter-Notice must substantially include the following information, as required by the DMCA:

Identification of Removed or Disabled Content: Identify the specific material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled. Please provide the original URLs or identifying information provided by Ruj.app in the notification of content removal.
Contact Information of the Counter-Notifying Party: Information reasonably sufficient to permit Ruj.app to contact you, such as:
- Your full legal name.
- Your address, telephone number, and email address.
Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. Example: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”
Consent to Jurisdiction: Your consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, the jurisdiction of the courts of England and Wales), and that you will accept service of process from the person who provided the DMCA Notice (the original complainant) or an agent of such person. Example: “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, and I will accept service of process from the person who provided the DMCA notification or an agent of such person.” **[If all your users are in the UK and you prefer UK jurisdiction, you may adjust this to solely reference courts of England and Wales, after legal review.]**
Signature: A physical or electronic signature of the Creator or a person authorized to act on their behalf. For electronic submissions, a typed full legal name will be considered a valid electronic signature.

Submitting Your DMCA Counter-Notice: You may send your complete DMCA Counter-Notice to our Designated Copyright Agent at the same contact information provided above for DMCA Notices (DMCA Agent contact details).

Ruj.app’s Response to DMCA Counter-Notices

Upon receipt of a valid and complete DMCA Counter-Notice, Ruj.app will take the following steps, in accordance with the DMCA:

Forwarding to Original Complainant: We will promptly provide the original complaining party (the copyright claimant) with a copy of the DMCA Counter-Notice.
Inform Complainant of Restored Access: We will inform the original complainant that we may reinstate the removed or disabled content within ten (10) business days, but no sooner than ten (10) business days and no later than fourteen (14) business days following receipt of the counter-notification, unless our Designated Copyright Agent first receives notice from the person who submitted the DMCA Notice that such person has filed an action seeking a court order to restrain the Creator from engaging in infringing activity relating to the material on Ruj.app’s system or network.
Content Reinstatement: If we do not receive notice that the original complainant has filed a court action within ten (10) business days of forwarding the counter-notice, we may reinstate the removed or disabled content. Ruj.app is not obligated to reinstate content and may choose not to do so at its discretion, particularly if there are ongoing concerns about potential infringement or violations of our Terms of Service.

Important Considerations Regarding AI-Generated Content and DMCA

Users and copyright holders acknowledge and understand the unique nature of AI-Generated Content. AI models generate outputs based on vast datasets and algorithms, and similarities in AI-Generated Content to existing copyrighted works may occur without direct copying or intentional infringement. Ruj.app will review DMCA Notices carefully, particularly those concerning AI-Generated Content, to distinguish between legitimate copyright infringement claims and situations where similarities may arise from the inherent nature of AI technology. However, this DMCA Policy is intended to address clear and demonstrable instances of copyright infringement, particularly unauthorized use of copyrighted material in prompts or direct replication of copyrighted works by AI Characters.

Misrepresentations in DMCA Notices and Counter-Notices

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled through mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by the copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

Modifications to this DMCA Policy

Ruj.app reserves the right to modify this DMCA Policy at any time and in its sole discretion. Any changes will be effective immediately upon posting of the revised DMCA Policy on the Ruj.app website. We encourage you to periodically review this DMCA Policy for any updates or changes. Continued use of Ruj.app services after the posting of changes to this DMCA Policy will constitute your acceptance of such changes.
